The Australian High Court has dismissed Apple's latest proposal seeking halt of the release of Samsung Galaxy Tab 10.1 in the country, and has enabled the natives to avail their most-awaited device.
"The Full Court of Australia decision on November 30 clearly affirmed our view that Apple's claims lack merit and that an injunction should not have been imposed on the Galaxy Tab 10.1”, said Samsung in a statement, while notifying that the Galaxy Tab 10.1 will be available in stores across Australia from this Christmas.
According to sources, the 16GB Wi-Fi version and the and the 16GB 3G Galaxy Tab of the tablet will be available in $579 and $729, respectively. However, a spokesman for Samsung denied confirming the prices on Friday.
Prior to this, the company authorities drafted policies for launching Samsung Galaxy Tab 10.1 in September in Australia but, the patent fight between Apple and Samsung has delayed its launch. Consequently, Apple succeeded in convincing a judge for postponing the product launch in the country while referring to evidences where the tablet, on various elements, breached the patent of Apple iPad 2.
Simultaneously, the Australian council for Samsung claimed that Apple has attempted outlining its claims on the United States model, although it accepted providing several models of the Australian prototype to Apple.
In Sydney, the Australian High Court ended the ban on Samsung, directing it to resume the of Galaxy tablet in Australia. Experts have anticipated that the ruling will play a significant role to benefit the South Korean company during the Christmas season. In the ruling, the court said that Apple infringing on a Motorola patent and explained it as a procedure for performing the countdown function.
All reputed companies, including Apple, Samsung, Motorola and HTC, are known to have some sort of involvement in patent-related entanglements.
